This website is created and managed by Upsound and Juicebox ApS (referred to herein as "Upsound," "we," "us," or "our"), and all subdomains are also managed by Upsound. Upsound is committed to treating all user information with confidentiality and respect. This privacy policy describes how Upsound and any affiliated companies handle personal information that we collect through the Upsound platform.

Upsound exists to connect musicians and service providers in the music industry, as well as to streamline and democratize the industry. For Upsound, both trust and transparency are important. A fundamental part of earning this trust involves clarifying how we use your information and protecting your right to privacy.

In the following policy, you can read about Upsound's commitments related to confidentiality and privacy. Over time, as our services evolve, there may be a need to use the information we collect in new and different ways. This may mean that we occasionally need to amend our Privacy Policy. If changes are made to our Privacy Policy, the date of implementation of these changes will be published on our website (referred to herein as the "Upsound platform") at the top of this text. 2. General Information

When the privacy policy applies+

This Privacy Policy applies when you use the Upsound platform and any other website, application, or service provided, owned, or controlled by Upsound. When you provide us with your information or use our platform, you accept, consent to, and agree to the way we collect and use your information. The manner in which we collect and use your information is outlined in this Privacy Policy. The provisions herein supersede all prior notices or statements regarding our Privacy Policy concerning our platform.

We believe you have the right to understand where your information is stored and used. We are not responsible for the level of confidentiality practiced by any third parties or content from linked pages. However, we always encourage you to read their privacy policy and general terms and conditions applicable to the platform, website, application, or other form of third party involved. In this regard, Upsound is no exception.

3. Personal Information We Collect

3.1 Information necessary to use Upsound platform+

We collect personal information about you when you use the Upsound platform. Without this information, we may not be able to provide you with all the desired services. This information includes:
  • Contact information, account details, and profile information, such as your first name, middle name(s), last name, phone number, mailing address, email address, date of birth, and profile and cover images, some of which may depend on the features you use.
  • Identity verification and payment information, such as images of your government-issued ID (as permitted by applicable law), your social security number or other information we may need to verify your identity, such as bank account or payment account details.

3.2 Information you may choose to provide us+

You can choose to provide us with additional personal information. These details may include:
  • Further profile details, such as gender, preferred languages, city, and personal description. Some of this information, as indicated in your account settings, is part of your public Upsound profile and will be publicly visible.
  • Contact information related to address. Addresses you import or enter manually.
  • Other information, such as when you fill out a form, add information to your account or profile, respond to surveys, submit posts to forums and/or our blogs, participate in campaigns, communicate with our support and other users, or share your experience with us. This may include health information if you choose to share it with us.

3.3 Information collected automatically when using the Upsound platform and our payment services+

When you use the Upsound platform and payment services, we automatically collect personal information. This information may include:
  • Information about geographical location, such as precise or approximate location determined from your IP address or GPS from your mobile device depending on the device's settings.
  • Information about usage, such as the pages or content you view, searches, bookings you have made, and other actions on the Upsound platform.
  • Log data and device information, such as details about how you have used the Upsound platform (including if you have clicked on links to third-party applications), IP addresses, access dates and times, hardware and software information, device information, unique identifiers, crash data, cookie data, and the pages you have viewed and engaged with before or after using the Upsound platform. We may collect this information even if you have not created an Upsound account or logged in.
  • Cookies and similar technologies described in our Cookie Policy.
  • Information about payment transactions, such as the payment instrument used, date and time, payment amount, payment instrument expiration date and billing number, IBAN information, your address, and other related transaction details.

3.4 Personal information we collect from third parties+

We collect personal information from other sources, such as:
  • Third-party services. If you link, connect, or log in to the Upsound platform using a third-party service (e.g., Facebook), you direct the service to send us information such as your registration, friend list, and profile information as governed by that service or as authorized by you through your privacy settings on that service.
  • Background information. To the extent permitted by applicable law and with your consent where required, we may obtain information about any crimes committed by you. We may use your information, including your full name and date of birth, to obtain such information.
  • Other sources. To the extent permitted by applicable law, we may receive additional information about you, such as references, demographic data, or information that helps detect fraud and security issues, from third-party providers and/or partners, and combine it with information we have about you. For example, we may receive background check results or fraud alerts from identity verification providers for use in our fraud prevention and risk assessment efforts. We receive information about you and your activities on and off the Upsound platform or about your experiences and interactions from our partners. We may receive health information, including but not limited to, health information related to infectious diseases. 

4. How we use the information we collect

4.1 Providing, improving, and developing the Upsound platform+

We use personal information to:
  • Provide you access to the Upsound platform and facilitate payments.
  • Enable you to communicate with other members.
  • Perform analysis, debug, and conduct research.
  • Provide customer service.
  • Send you messages, updates, security alerts, and account notifications.
  • Personalize and customize your experience based on your interactions with the Upsound platform, your search and booking history, your profile information and preferences, and other content you submit.
  • Facilitate your use of our products.

4.2 Establishing and maintaining a reliable and safer environment+

We use personal information to:
  • Detect and prevent fraud, spam, abuse, security incidents, and other harmful activity.
  • Detect and combat discrimination in accordance with general anti-discrimination policies.
  • Conduct security investigations and risk assessments.
  • Verify or authenticate information provided by you.
  • Perform checks of databases and other sources of information, including background or criminal checks.
  • Comply with our legal obligations, protect the health and well-being of our users.
  • Resolve disputes between our users.
  • Enforce our agreements with third parties.
  • Comply with the law, respond to legal requests, prevent harm, and protect our rights (see section 5.5).
  • Enforce our terms and conditions and other policies, and;
  • In connection with the above activities, we may conduct profiling based on your interactions with the Upsound platform, your profile information, and other content you submit to Upsound, as well as information obtained from third parties. In limited cases, automated processes may restrict or suspend access to the Upsound platform if such processes detect activity that we believe poses a security or other risk to Upsound, our users, or third parties. 4.3 Providing, personalizing, measuring, and improving our advertising and marketing+

We may use personal information to:
  • Send you promotional messages, marketing, advertising, and other information based on your preferences and advertise on social media platforms via social media platforms.
  • Personalize, measure, and improve our marketing efforts.
  • Administer referral programs, rewards, surveys, contests, or other promotional activities or events sponsored or managed by Upsound or our third-party partners.
  • Analyze characteristics and preferences to send you messages, marketing, advertising, and other information that we believe may be of interest to you, and;
  • Invite you to events and relevant opportunities.

4.4 Providing payment services+

We use personal information to enable or authorize third parties to use payment services to:
  • Detect and prevent money laundering, fraud, abuse, and security incidents.
  • Conduct security investigations and risk assessments.
  • Comply with legal obligations (such as anti-money laundering regulations).
  • Enforce payment services and other payment policies.
  • With your consent, send you advertising messages, marketing, advertisements, and other information that may be of interest to you based on your preferences, and;
  • offer and improve payment services.

5. Sharing and Disclosure

5.1 Sharing with your consent or at your direction+

Where you provide consent, we share your information as described at the time of your consent, for example, when you authorize a third-party application or website to access your Upsound account or participate in promotional activities by Upsound partners or third parties.

Where permitted by applicable law, we may use certain information about you, such as your email address, de-identify it, and share it with social media platforms to generate leads, drive traffic to Upsound, or otherwise promote our products and services.

5.2 Sharing between users+

To help facilitate bookings or other interactions between users, it may be necessary for us to share certain information, such as:
  • When a booking request is made or information about a dispute between users is submitted, certain information may be shared between Service Providers and Buyers, including profile, photos, name, name of any additional involved users, cancellation history, review information, age (unless prohibited by applicable law), dispute resolution outcomes (when relevant), and any other information you choose to share and submit.

5.3 Information you publish on profiles, listings, and other public information+

You may make certain information publicly visible to others, such as:
  • Your public profile, which includes, but is not limited to, name, profile picture, description, and city or area.
  • Reviews, ratings, and other public feedback.
  • Content from a community or discussion forum, a blog, or a social media post.

We may display portions of your public profile and other content you make available to the public on third-party websites, platforms, and apps. 

Information you share publicly on the Upsound platform may be indexed by third-party search engines.

5.4 Compliance with laws, response to legal requests, prevention of harm, and protection of our rights+

We may disclose your information to courts, law enforcement agencies, governmental or public authorities, tax authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law, or where disclosure is reasonably necessary: (i) to comply with our legal obligations, (ii) to comply with a valid legal request or to respond to claims made against Upsound, (iii) to respond to a valid legal request in connection with a criminal investigation to address alleged or suspected illegal activity or to respond to or address any other activity that may expose us, you, or other of our users to legal or regulatory liability, (iv) to enforce and administer our agreements with users, or (v) to protect the rights, property, or personal safety of Upsound, its employees, its users, or the public.

Where relevant, we may notify users about legal requests, unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of personal injury or bodily harm to an individual or group, or create or increase the risk of fraud or harm against Upsound, our users, or expose Upsound to a claim of obstruction of justice.

5.5 Service Providers+

We share personal information with affiliated and non-affiliated service providers to assist us in operating our business, including service providers who help us with: (i) verifying your identity or authenticating your identification documents, (ii) checking information against public databases, (iii) conducting background or police checks, fraud prevention, and risk assessment, (iv) performing product development, maintenance, and debugging, (v) enabling the delivery of Upsound services through third-party platforms and software tools (e.g., through integration with our APIs), (vi) providing customer service, advertising, or payment services, (vii) processing, managing, or evaluating insurance claims or similar claims, or (viii) facilitating nonprofit or charitable activities in accordance with Upsound's general mission and objectives. These providers are contractually obligated to protect your personal information and have access to your personal information to perform these tasks. 

5.6 Business Transfers+

If Upsound becomes involved in a merger, acquisition, reorganization, sale of assets, bankruptcy, insolvency event, or similar transaction, we may sell, transfer, or share some or all of our assets, including your information, in connection with such transaction or in contemplation of such transaction. In this case, we will notify you before your personal information is transferred and becomes subject to a different privacy policy. 

6. Legal Basis for Using Your Personal Information

Our legal basis for using your information+

Our legal bases for using your information are as follows. These are applicable to the extent they are consistent with applicable law. They are as follows:
  • To fulfill our contractual obligations to you: Much of the processing of personal data is carried out to comply with our contractual responsibilities to our users, or at the user's request to take steps towards entering into a contract with them. For example, we process personal information on this basis to grant you access to/create a user account on the Upsound platform.
  • To enable and facilitate transactions and agreements between Upsound and users.
  • Consent: Where required, and in some other cases, we process personal information based on your implicit and explicit consent.
  • Legitimate Interests: In many cases, we process personal information on the basis that it furthers our legitimate interests in commercial activities that are not overridden by the interests or fundamental rights and freedoms of the affected users. This includes, but is not limited to, the operation of our business and the Upsound platform, providing security for the Upsound platform, products, software, or applications, marketing, facilitating and receiving payments, and preventing fraud.
  • Compliance with Legal Obligations: We are required to use and disclose personal information in some instances to comply with our legal obligations (such as our duty to share data with tax authorities).

7. Other Important Information

7.1 Analyze your communication+

We may review, scan, or analyze your communication on the Upsound platform for reasons described in the section "how we use the information we collect'' in this policy, including fraud prevention, risk assessment, compliance with the law, investigation, product development, research, analysis, enforcing our terms and conditions, and for purposes related to customer support. For example, as part of our fraud prevention efforts, we may scan and analyze messages to conceal contact information and references to other websites. In some cases, we may also scan, review, or analyze messages between Users to debug, improve, and expand product offerings. We use automated methods where reasonable. Occasionally, it may be necessary to manually review communication, for example, for fraud investigation and customer support, or to assess and improve the functionality of these automated tools. We do not review, scan, or analyze your message communication to send third-party marketing messages to you, and we do not sell reviews or analysis of this communication.

7.2 Linking of third-party accounts+

You can link your Upsound account to certain third-party services such as social media. When you initiate data sharing by creating this link:
  • some of the information provided to us from linking accounts may be published on your profile,
  • your activities on the Upsound platform may be displayed on these third-party services,
  • a link to your public profile on this third-party service may be included in your public Upsound profile,
  • information you provide us from linking your accounts may be stored, processed, and transmitted for the purpose of fraud prevention and risk assessment, and
  • disclosure and display of information you provide to the Upsound platform through this linking is subject to your settings and authorizations on the Upsound platform and the third-party service.

7.3 Third-party partners and integrations+

Parts of Upsound may link to third-party services not owned or controlled by Upsound. Your use of these services is subject to the privacy policies of those providers. Upsound neither owns nor controls these third parties, and when you interact with them, you may be providing your information to them.

8. Your rights

8.1 Your rights+

You can exercise the rights described in this section in accordance with applicable law. Please contact support@upsound.com to make such a request. Note that we may ask you to confirm your identity before taking any further actions regarding your request. 

8.2 EU Rules+

EU citizens have certain rights available under applicable EU data protection law (including GDPR). Since Upsound operates within the EU borders, all users of Upsound will be covered by this law. Please note that we may need to update your information for our legitimate interests or to comply with legal obligations. If these rights apply to you, they entitle you to request to:
  • access and/or copy certain personal information that we have about you,
  • prevent your personal information from being used for direct marketing,
  • update personal information that is outdated or incorrect,
  • delete specific personal information we have about you,
  • restrict the way we process or disclose specific personal information about you,
  • transfer personal information to a third party that provides services, and
  • revoke consent to process your personal information, which you previously consented to us using.

8.3 Handling of your information+

You can access and update some of your personal information via your profile settings. You are responsible for keeping your personal information up to date. 

8.4 Data deletion+

You can request your personal information to be deleted. Please note that if you request deletion of your personal information:
  • We may retain your personal information as needed for our legitimate business interests, such as preventing money laundering, detecting and preventing fraud, and enhancing security. For example, if we suspend an Upsound account due to fraud or security reasons, we may retain information from that Upsound account to prevent the user from opening a new Upsound account in the future.
  • We may retain and use your personal information to the extent necessary to comply with our legal obligations. For example, Upsound may retain information regarding tax obligations, legal reporting, and auditing.
  • Information you have shared with others (e.g., reviews or blog posts) will still be publicly visible on Upsound even after your Upsound account has been deleted. However, attribution of such information to you will be removed. Some copies of your information may remain in our database but will be separated from personal identifiers.
  • As we take measures to protect data against accidental or malicious loss and destruction, residual copies of your personal information may not be removed from our backup systems for a limited period.

8.5 Opting out of offers+

If you do not wish to receive offers, promotional material, or marketing-related communications from us in the future via email, you can simply opt out by unsubscribing through the link in the emails or by contacting us at support@upsound.com. Please write "unsubscribe" or "opt-out" in the subject line.

Please note that if you choose not to receive offers, promotional material, or other marketing communications, we may still send you non-promotional communications, such as security alerts or notifications related to your access to or use of the Upsound platform or related services, or about your online account or our ongoing business relationship.

9. Security

9.1 We do what we can to protect your information+

Even though no organizations or companies can guarantee perfect security, we continuously implement and update administrative, technical, and physical security measures to protect your information against unauthorized access, loss, destruction, or alteration.

Access to your personal information and user activity is restricted to those who provide the necessary credentials and who need access, such as our administrators or support staff. The payment system is provided through third parties, who are responsible for protecting your payment information.

If you are a user, you are responsible for maintaining the confidentiality of your username and password. If you use the Upsound platform, you are responsible for limiting access to your computer or connected devices, and you agree to accept responsibility for all activity that occurs under the use of your username or password. You agree to notify us immediately if there is any unauthorized use of your account and any other security breach. We reserve the right to refuse services, delete users, or remove or edit content at our discretion.

10. Changes to this Privacy Policy

10.1 Changes to this Privacy Policy+

We reserve the right to change this privacy policy at any time in accordance with applicable law. If we do, we will post the revised privacy policy and update the "last updated" date at the top of the page. In the event of significant changes, we will also notify you of the change(s) via email at least 30 days before the effective date. If you disagree with the revised privacy policy, you may delete your Upsound account. If you do not delete your account before the effective date of the revised privacy policy, your continued access to and use of the Upsound platform will be subject to the revised and last updated privacy policy. 

11. Children's Privacy

11.1 Children's Privacy+

The Upsound platform is not designed for and has no intention of being used by children below the specific legal age in the respective country (minors). We will not knowingly collect identifying personal information from any minors whatsoever. If you are below the legal age and thus unable to consent to the use of your personal information, please refrain from providing us with any data.

If we become aware that we are processing data from someone who is too young, we will cease all processing and take reasonable steps to promptly remove all available personal information about that individual from our database.
